Residential Conveyancing

Motoring Offences

Case type: A - Simple

Description:

A straight forward road traffic case such as a drink driving or speeding case where a Guilty Plea is to be entered and the matter will be concluded on the first return date.

Factors likely to make the cost at the higher end of the range:

  • Not Guilty Plea.

  • Volume of evidence.

  • Complex legal issues.

  • More than 1 court appearance.

  • Adjournment application required

  • Exceptional hardship argument or special reasons argument.

Case Type: B - Medium

Description:

A more complex road traffic case such as a drink driving or speeding case where there are a number of legal issues involved or a Not Guilty Plea is to be entered.

Factors likely to make the cost at the higher end of the range:

  • Volume of documentation.

  • More than 1 defense witness/ a necessity to take numerous witness statements.

  • Complex legal issues.

  • More than 1 court appearance.

  • Adjournment application required.


Case Type: C - Complex

Description:

A complex road traffic case such as dangerous driving, causing death by dangerous driving.

 Factors likely to make the cost at the higher end of the range:

  • Volume of documentation.

  • Multiple witnesses.

  • Complex legal issues.

  • Medical or other expert evidence involved

  • More than 1 court appearance.

  • Adjournment application required.


Our Pricing

Those who do not qualify for legal aid will find our private client charges to be competitive, and we will keep you informed about all fees so there are no unpleasant surprises. Depending on the circumstances of the case, we may be able to offer fixed fees, so please contact one of our driving offence lawyers for an estimate.

The list below outlines the types of driving offences that Stonewood Lawyers' legal specialists can defend for you, as well as a cost estimate.

Please keep in mind that all of the charges indicated below are subject to VAT, and they do not include any additional costs such as barristers' or experts' fees.

Each case is unique, and once the facts of your case have been determined, we can provide an estimate of any additional charges that may be spent so that you are informed of the cost up front.

Exceptional Hardship / Totting up Penalty Points (Guilty Plea)

• Representation costs are between £500-£1000

Speeding Offences ( Guilty Plea)

• For written representation on a speeding offence, defence costs are between £200 and £400.
• Representation for a guilty plea in Court will cost between £300 and £600

Drink Driving / Drug Driving / Failing to Provide a Specimen

• Guilty Plea – £200 – £500
• Guilty Plea and Special Reasons – £500 – £1000
• Not Guilty Plea and trial – £1000-£2000

All of the above are subject to VAT.

What do these prices include?

Not Guilty Plea estimates based on first hearing and maximum one day trial.

Estimates do not include additional disbursements such as travel costs and expert report fees (as mentioned above).

Guilty Plea prices include:
• Initial meeting to ascertain the facts of your case and take instructions.
• Meeting at court prior to hearing
• Representation in Court hearing
• Any necessary advice & assistance post hearing
• Reviewing evidence necessary to your particular case
• Advice regarding the case, the Court process (if necessary) and what to expect.

Duration of your case:

Each case is unique, and we can provide you with an estimate during your initial appointment.

Our team will work with you at every step of the way, keeping you informed and updated with the status of the case.

The length of time it takes to resolve a case depends on whether a guilty plea is entered or if the case goes to trial with a full court hearing.

For guilty plea cases, this will depend the court date for the final hearing. For not guilty pleas the average time span is 3-6 months.

Any summary only traffic offences must be "issued" within six months of the date of the offence. The speed with which proceedings are issued or cases are listed is determined by the court that handles the case and how busy that court is.

There is a time limit for each stage of the proceedings that must be followed:

Within 14 days after the incident, the registered keeper of a vehicle must be issued with a Notice of Intent to Prosecute (NIP).

NIPs must be returned within 28 days of receiving them. Failure to do so results in a six-point penalty.

Within six months, court actions must be filed;

Notices issued under the Single Justice Procedure must be responded to within 21 days;

It is critical to get legal counsel as soon as possible. On individual circumstances, we can provide more information about time frames.

Duration

The process of obtaining the licence usually takes 4 to 16 weeks, although it might take much longer if the local government has concerns about certain aspects of the case. If you have any further questions in regards to the timescale please do not hesitate to contact us directly.

Probate Services

Our Probate fees can vary in accordance to individual circumstances as we offer a bespoke service for each unique matter.

Stonewood Lawyers offers both fixed fees and an hourly rate charge (being charged for each hour where work is undertaken).

Fixed Fee

Here at Stonewood lawyers we are able to guide and help you through the complex process by obtaining the Grant of Probate on your behalf. Our fixed fees do not include any distribution or identification of assets, being limited to obtaining Grant of Probate.

Hourly Rate

Our guideline of legal fees for an average estate is normally in the region of £2,400 to £4,800 with the addition of VAT and Disbursements.

However the fee amount may vary and are dependent upon the nature and size of the deceased’s estate.

Legal costs to administer an estate are further dependent on issues as:

  • Assets or Shares

  • Liabilities

  • Beneficiaries

  • If the estate includes property

  • Multiple bank accounts

We are able to manage the full process for you where in the estate:

  • The only trusts arising in the Will are life interest trusts or bare trusts for minors

  • There is no inheritance tax payable and the executors do not need to submit a full account to HMRC (i.e. an IHT205 is required)

  • There are no claims made against the estate

  • There are no more than 2 UK shareholdings

  • There are no intangible assets

  • There are no more than 4 beneficiaries

  • There are no disputes between beneficiaries on the division of assets. If disputes arise this will lead to an increase of costs and would normally be dealt with by our litigation team who would charge separately for such matters.

  • There is a valid Will

  • There is no more than one property

  • There are no more than 5 bank or building society accounts

Disbursements are fees paid to third parties that are relevant to your case, such as Land Registry or court expenses. To guarantee a simpler operation, we manage the payment of disbursements on your behalf. Please be aware that we may require the Executor to make disbursements in advance, such as the probate court charge. Normally, once funds are available, this expense would be reimbursed from the estate.

Inheritance Tax

The size of the estate and any procedures put in place by the deceased to minimise the estate's tax burden are two factors that will effect any Inheritance Tax due on an estate.

Exclusions

There may be circumstances that would generally increase the cost of the costs involved even though our fees are anticipated and include the items listed above. If there are likely to be any additional costs, we will notify you as soon as possible and provide a detailed estimate of such costs.

Additional services that will require the assistance of a third party at additional cost include:

  • Tax advice

  • Valuations for property, savings, investments or other assets

Time Scales

Probate might take anywhere from 6 to 12 months depending on the size of the estate. In most cases, the time it takes to obtain a Grant of Probate is between 3 and 6 months (where the estate is not taxable and a form IHT400 is not required). The series is designed to handle everything from simple estates to more difficult estates, albeit larger and more complicated estates may take longer to administer. If any delays are expected, we will make every effort to keep you informed.

There are crucial milestones in every transaction, which may change depending on the circumstances, these are:
